Accountant John W. Beakley filed a Chapter 7 petition Monday in federal bankruptcy court in Dallas — a move that creates a major impediment to a month-old securities fraud lawsuit filed against him in U.S. District Court in Lubbock.

Federal bankruptcy law requires an automatic stay of suits and similar legal proceedings against the person who files. Chapter 7 is the portion of the bankruptcy code that leads to liquidation.

The petition was an individual filing that did not list Beakley’s wife, Mary Jan as a joint debtor. The filing also did not include numerous financial statements and a list of creditors; those must be filed within 14 days. Samuel K. Douglass and sons Mark, Scott and Timothy, sued Beakley, members of his family, and more than 100 businesses he controls alleging the accountant mismanaged nearly $10 million he agreed to invest on their behalf.

More than three out of four real estate professionals surveyed who registered to attend the 2012 Leading Real Estate Companies of the World(R) Conference that began yesterday in Orlando, Florida selected an iPad Presentation App as the single most preferred marketing tool they would like to have, according to a new survey released today by Imprev, a leading real estate marketing technology company.

The iPad Presentation App topped a list of 25 different marketing products, from which respondents chose up to five different products they would like to have. The next most popular marketing product was automated (or “Drip”) eMarketing Campaigns (35%), followed by Single Property Websites (29%), a Personal Blog (28%) and Video (25%).

“Real estate agents are shouting that they want their iPad apps,” said Renwick Congdon, CEO and Founder of Imprev, the marketing technology firm that conducted the survey and a sponsor at this week’s LeadingRE MarTech Event for marketing and technology professionals. Congdon also pointed to his firm’s internal research, which shows the explosive popularity of iPad-enabled designs it offers real estate brokerage firms. “The iPad from Apple is quickly becoming a ubiquitous marketing and productivity tool for the real estate industry,” Congdon said.

Davis explained how he and nearly all walking horse trainers use the tools, along with “mustard oil” — a mix of acid and kerosene or other chemicals — to tenderize and injure horse hooves. By driving bolts, wrapping chains and slathering corrosive liquids on the animals’ hooves, trainers such as Davis can make them lift their legs higher and win fancy ribbons and trophies for the horse owners. The practice eventually can cripple the animals, he told U.S. District Judge Harry “Sandy” Mattice on Monday.

The practice, known as “horse soring,” is illegal under the federal Horse Protection Act. Davis, of Lewisburg, Tenn., and three co-defendants have been sentenced after pleading guilty to charges related to abusing horses.

“Every walking horse that enters into a show is sored,” Davis said. “They’ve got to be sored to walk. There ain’t no good way to put it but that’s how it is.”

Speaking to City Council’s public works committee Tuesday night, Public Works Director Dave Hopkins recommended a $5 increase in the fees for season passes at Easton’s two public pools.

“That keeps us very competitive,” Hopkins said, noting that the fees will still be less than what Wilson and Palmer Township charge for season passes.

Under the new plan, the cost to buy day-to-day access at Heil and Eddyside pools would not change, Hopkins said. Last year, the city sold 453 season passes. Hopkins said the increase will generate about $2,300 in revenue…Continue Reading
